Charges Filed Against Foreclosure Rescue Fraud Duo

Many homeowners in crisis have turned to so-called foreclosure “rescue” firms. The owners of one such New Jersey foreclose rescue firm are being sued for allegedly violating state consumer fraud laws, as well as laws governing debt counseling and financial advertising.

According to a complaint filed in December, Marcus A. Mullings Jr. and Talia Stephen-Mullings, both of Fort Lee, and Jessie Sanders, of West Orange, owned and operated “Stay In or Walk Away,” a company that advertised itself as an alternative to foreclosure. The complaint alleges that Stay In or Walk Away charged homeowners up to $1625 a month in foreclosure services that were never delivered.

The company allegedly operated three programs: a “Stay in Your Home” plan that promised to negotiate a new, lower-cost mortgage on behalf of homeowners; “Walk Away Free & Clear” that promised to negotiate a short sale; and “Stop the Sale Date” plan that promised to halt foreclosure auctions. The company allegedly never delivered these services. The suit was brought by New Jersey Attorney General Christopher Porrino and seeks restitution and civil penalties.

Attorney General Porrino stated that his office has “alleged these defendants shamelessly exploited homeowners who were drowning in mortgage debt and desperate to hang onto their homes.” Even worse, the program was responsible for “causing people to fall further behind on their mortgages, as they paid for undelivered services with money that could have been applied to their mortgages.”
