Bankruptcy Meeting of Creditors

On Behalf of | May 3, 2013 | Chapter 13 Bankruptcy, Chapter 7 Bankruptcy

All bankruptcy debtors are required by the Bankruptcy Codeto attend the meeting of creditors (also called the 341 meeting); yet in most cases, it is a very quick and painless process.. Usually the meeting does not last very long and it is fairly casual. First of all, although they are invited, creditors rarely attend the meeting, and you will not be before a judge, although you are under oath.  Rather you will meet with the bankruptcy Trustee who is  an individual appointed to administer the bankruptcy.  The debtor answers question under oath about their bankruptcy and the information in their petition.

An experienced bankruptcy lawyer will fully prepare you and attend your 341 meeting with you.

When you attend the 341 meeting, it is important to be on time and bring your social security card and picture identification.

A few examples of questions the trustee typically asks the debtor are as follows:

 ·         Did you read the petition before signing?

·         Did you list all of your debts?

·         Where do you live and where do you work?

·         Do you own any real property other than your home?

·         Have you reviewed your bankruptcy petition and is everything true and correct?

·         Did you list everything that you own and everything that you owe?

·         Do you have any claims against anyone (like a lawsuit)?

·         Why did you file for bankruptcy?
