Sheriff Sales Have Resumed in New Jersey

You Can Stop the Sheriff Sale & Save Your Home

Since the beginning of the COVID-19 pandemic, every County Sheriff in New Jersey stopped conducting sales on non vacant residential properties. Beginning in September, 2021 Sheriff Sales on all residential properties have resumed in many New Jersey Counties. It is likely they will begin in all NJ Counties by sometime in November, 2021.

If you have received a Notice that your home has been scheduled for a Sheriff Sale, contact us immediately if you want to stop the Sheriff Sale. There are steps you can take to either delay the Sheriff Sale or permanently stop the Sheriff Sale and save your home.

Below is a list of each NJ County Sheriff’s office (hyperlinked to their website) and the status of their Sheriff Sales on occupied residential property as of September 23, 2021. For up-to-date information you should contact the Sheriff for the County.

Find Out If Your Home is Listed for a Sheriff Sale

If your property had already been listed for a Sheriff Sale before the Sales were stopped, you must check the Sheriff’s website for the County in which your home is located to see if it has been rescheduled. You can also call the Sheriff’s Office. It is not guaranteed that you will receive written notice of the rescheduled Sheriff Sale date.

What Are My Options for Stopping a NJ Sheriff Sale?

The following are ways you can delay a NJ Sheriff Sale or stop it entirely and save your home.

  • Adjourn the Sheriff Sale.

    Homeowners are entitled to two adjournments of the Sheriff Sale. Each adjournment can be up to 30 days. If you did not request one or both of the Sheriff Sale adjournments before the pandemic, they are still available to you. To obtain these adjournments you should contact the Sheriff’s Department in your County to determine the exact process in the County.

  • Filing a Chapter 13 Bankruptcy

    . When a Chapter 13 Bankruptcy is filed, an automatic stay is put into place which stops the Sheriff Sale from taking Place. A Chapter 13 Bankruptcy allows you to permanently save your home if you can resume paying your mortgage and cure the missed payments over 3 to 5 years, or you can get a loan modification. If you have equity in your house, a Chapter 13 bankruptcy might give you the time you need to sell the house.

  • File a NJ Chapter 7 Bankruptcy to Delay the Sale.

    A Chapter 7 Bankruptcy will delay the Sheriff Sale and eliminate your unsecured debt. This will help you find and afford a new place to live. A Chapter 7 Bankruptcy will not help you permanently save your home.

  • Apply for a Loan Modification.

    If you have enough income you might qualify for a loan modification. If a completed loan modification is submitted more than 37 days before the date of the Sheriff Sale, the lender must adjourn the Sheriff sale and review the loan application.
    We recommend applying for a loan modification as part of a Chapter 13 bankruptcy since it is the position of many lenders that the completed loan modification application must be submitted 37 days before the first scheduled Sheriff Sale date.
